By accessing our website, booking a free product demo, or utilizing the Kitchio branded restaurant online ordering software, systems, and related merchant APIs, you agree to comply with and be bound by these Terms of Service. Please read them carefully.
These terms govern the business relationship between Kitchio Ltd. ("Kitchio", "we", "us") and the restaurant merchant operator ("Merchant", "you").
1. Platform Scope & Services Provided
Kitchio provides customizable direct-ordering software applications, hosted web pages, QR code ordering generators, digital loyalty tools, and integrations with third-party payment and courier logistics networks. Kitchio assists in configuring, uploading, and publishing the Merchant's custom website, typically deploying the direct online ordering store in under 48 hours.
2. The 0% Commission Model
Kitchio operates on a **0% transaction commission model** on food and beverage ordering volume. We do not extract percentage revenue commissions from your direct customer sales. Payment handling transaction costs are governed exclusively by Stripe's direct processing guidelines (Standard UK card transaction rates apply: e.g., 2.2% + 30p).
Merchant payouts route directly to your designated business bank account via your independent Stripe dashboard. Kitchio does not hold, delay, or manage your restaurant sales revenues.
3. Direct Merchant Data Ownership
Merchants maintain 100% legal ownership of the customer files (including Diner email addresses, phone contacts, names, and purchase logs) captured through your branded ordering website. Kitchio acts solely as a technical data processor. We will never use your custom diner records to market third-party platforms or competitor restaurant offers.
4. Automated Logistics & Courier Fulfillment
Kitchio integrates with on-demand logistics networks (e.g., Stuart, Uber Direct) to coordinate delivery couriers for online orders. - Delivery fees are computed dynamically using distance-based algorithms during checkout. These fees are funded directly by the Diner during payment. - Kitchio coordinates logistics dispatch automatically upon order validation. - Kitchio is a software provider and does not directly employ the couriers. We are not liable for delayed, incomplete, or damaged order transit caused by third-party delivery dispatch partners.
5. Onboarding & Menu Configuration
You agree to provide accurate menu files, pricing sheets, images, and geographic delivery zone boundaries during onboarding. While Kitchio handles initial configuration and configuration setups, the Merchant remains fully responsible for: - Verifying allergy alerts, ingredient descriptions, and menu price updates. - Ensuring compliance with local food safety and commercial trading rules. - Fulfilling accepted orders in a timely and professional manner.
6. Subscription Billing & Cancellations
Kitchio subscription fees are billed monthly according to your selected plan (e.g., Growth, Pro). Payments are handled via recurring credit card processing. - **No Setup Fees:** We build, upload, and deploy your site with £0 upfront charges. - **No Long-Term Commitments:** You may terminate your subscription plan at any time without exit penalties. Cancellation requests take effect at the end of the current monthly billing period.
